A social media influencer named Sapna Gill filed a complaint against cricketer Prithvi Shaw, alleging that he molested her at a pub.
However, the court rejected her plea seeking action against the police for not registering a case on her complaint against Shaw and his friend.
Gill filed a review application before a sessions court in Malad, claiming that the order passed by the metropolitan magistrate on April 3 was irregular and illegal.
On Tuesday, an additional sessions judge issued summons to Shaw and the airport police for not registering a case when Gill had first approached them.
Gill was arrested in February 2023, along with some others, for attacking Shaw after an argument over clicking selfies at a suburban hotel.
She is currently out on bail. After being granted bail, Gill filed a complaint of molestation against Shaw, his friend Ashish Yadav and others at the airport police station in Andheri.
When the police did not register a case against the cricketer, she moved the magistrate court.
In her complaint, Gill sought registration of an FIR against Shaw and Yadav for allegedly assaulting her with a bat under Indian Penal Code sections 354 (molestation), 509 (word, gesture or act intended to insult the modesty of a woman), and 324 (voluntarily causing hurt by dangerous weapons or means). The matter will be next heard on June 6.
